今年是长三角区域一体化发展上升为国家战略五周年,是习近平总书记在合肥主持召开扎实推进长三角一体化发展座谈会并发表重要讲话三周年。在这样的重要时间节点,上海、江苏、浙江、安徽人大监察和司法委员会近日聚首安徽金寨,共商协同推动生态环境公益诉讼大计。在长三角区域一体化发展战略引领下,三省一市人大监察和司法委员会持续深化协同协作,聚焦长三角区域的生态建设,协同推动生态环境公益诉讼,积极打造生态修复样板区和“两山”理论实践创新“试验田”,形成联系紧密的生态环境共同体,携手共建绿色美丽长三角,助力长三角更高质量一体化发展。
制度供给一体化
2020年11月13日,安徽省十三届人大常委会第二十二次会议通过《关于加强检察公益诉讼工作的决定》,明确要求,加强与长江三角洲区域检察机关的协作配合,积极探索完善检察公益诉讼协作机制,加强信息共享、线索移送、调查协作、联动办案等工作,推动跨区域系统化治理。就在同一年,上海、江苏、浙江人大常委会均已通过《关于加强检察公益诉讼工作的决定》,并作出类似规定。
“长三角地区三省一市人大还围绕长江环境保护、长江禁渔等重点任务,通过协同立法、联动监督、联合出台决定、代表工作互动等方式载体,找准履职切入点、结合点、着力点,为促进长三角区域生态环境公益诉讼协作提供坚强法治保障。”安徽省人大常委会副主任韩军说,沪苏浙皖地缘相近、山水相连、河湖相通,生态环境休戚与共,而深化长三角生态环境保护检察协作,开展生态环境公益诉讼,进一步规范和保障公益诉讼司法工作,自然就成为了建立长三角公益诉讼工作协同机制的优先领域之一。
有了地方人大立法保障和指引,沪苏浙皖之间开展了各种形式生态环境协作。长三角地区三省一市认真贯彻长江保护法和沪苏浙皖人大常委会分别通过的促进和保障长江流域禁捕工作若干问题的决定,依法维护长三角区域生态系统完整性;沪苏浙皖检察机关会签《长三角区域检察协作工作办法》《关于依法全面充分履行检察职能为扎实推进长三角一体化发展提供司法保障的意见》等文件,围绕不断提升服务长三角更高质量一体化发展能级,聚焦长江大保护、长三角绿色一体化发展、生物多样性保护、助力碳达峰等,形成共保合力,聚力突破重点问题“形成一盘棋”。长三角地区三省一市高院联合签署《长三角地区人民法院环境资源司法协作框架协议》,共同推进长三角生态环境一体化司法保护。
除此以外,三省一市或两地或三方采取灵活方式,结合当地生态保护特点建立符合实际的制度机制,比如:安徽省人民检察院参与构建长江、淮河、新安江、环太湖流域跨省协作新模式,指导全省各级检察机关与相邻省份兄弟单位建立涉长三角区域协作机制20余个;上海市青浦区人民检察院与浙江嘉善、苏州市吴江区检察机关密切协作,先后签订实施《关于建立青嘉吴检察机关一体化发展太浦河流域生态资源公益诉讼协作机制的意见》等4项机制,推动“三难管”地区变“三共管”示范区,等等。
安徽省人大监察和司法委员会主任委员樊勇说,公益诉讼是一项系统工程,长三角地区是一个联系紧密的生态环境共同体。通过加强地方立法,持续制度供给,细化落实相关法律要求,探索建立信息共享、协作配合的一体化跨区域检察公益诉讼协作机制,健全长三角一体化生态环境公益诉讼的“四梁八柱”,突破各种行政区域壁垒和各类公益诉讼办案“断头路”,推动生态环境保护公益诉讼走深走实,不断增强人民群众对优美生态环境的获得感幸福感安全感,让长三角地区绿水青山的“生态颜值”愈发美丽动人。
监督机制体系化
听取和审议检察机关提起公益诉讼工作情况报告,紧盯生态环保领域特别是长三角区域环境公益诉讼案件办理情况;
实地检查《决定》贯彻实施情况和检察公益诉讼工作现状,查找问题,研究加强和改进工作的具体举措;
要求检察机关以办理相关重点案件为抓手,突出办理生态环境保护领域的公益诉讼案件,严厉惩处破坏生态环境的违法行为;
聚焦长江、大运河、淮河、太湖等长三角区域重要生态系统,组织开展守护长江、江河湖海生态环境和资源保护等专项监督;

监督是推进法治实施的重要手段。沪苏浙皖人大围绕检察公益诉讼和环境资源审判工作,通过强化执法监督、组织代表实地视察、听取审议专项报告、开展专题询问等一系列监督活动,以强监督来推动强落实,积极稳妥推进生态环境公益诉讼,筑牢司法保护屏障。
“长三角地区各级人大注重主动融入公益诉讼整体监督体系,尤其支持检察机关开展法律监督工作,在不同领域、从不同角度、以不同方式全方位支持强化检察机关法律监督职能作用,不断放大监督的集成效应。”安徽省人大监察和司法委员会副主任委员潘法律说,在监督支持司法机关为生态环境和资源保护提供坚强有力司法保障的同时,督促相关行政机关严格环境保护制度,加大对违法行为的惩治力度、提高环境违法成本,凝聚起生态环境公益诉讼保护的合力。
长三角地区三省一市各级人大还将人大监督与法律监督紧密结合,注重发挥人大代表密切联系群众的独特优势,建立完善人大代表建议与公益诉讼检察建议双向衔接转化工作机制,建立生态环境保护领域代表议案建议联办制度,加强对重要检察监督意见办理情况开展督办等工作的协作。
安徽省人大监察和司法委员会副主任委员张冬云说,生态环境和资源保护是检察公益诉讼法定办案领域,也是检察公益诉讼最大的办案领域。检察机关深化与相关部门在信息共享、线索移送、咨询协助、案件联办等方面的协作配合,通过从代表建议中摸排公益诉讼问题线索,不仅拓宽了公益诉讼检察建议的线索来源,而且提高了人大代表建议的办成率,更重要的是,推动解决了一批人民群众关注的实际问题,实现了政治效果、法治效果、社会效果相统一。
协同联动实质化
开展生态环境公益诉讼是长三角区域工作协同的重要内容,如何做好协同联动是一道必答题。经过不断实践,内外联动、横向交流、互相借鉴的协同联动机制逐渐成型,一系列一体化标准应运而生,一件件协同协作的案件成为经典。
沪苏浙皖检察机关积极推动跨区域系统化治理,积极推动环境损害司法鉴定协同发展,推进区域司法政策适用标准统一;
审判机关立足生态环境保护内在规律,不断探索完善环境资源案件裁判规则体系,创设了一批具有全国影响力的裁判规则,实现了惩治违法犯罪、赔偿经济损失、修复生态环境“一判三赢”的效果;
张某山等非法采砂民事公益诉讼案,经由江苏省建湖县人民检察院起诉,法院将被告缴纳的环境修复金及时移交安徽铜陵法院用于异地修复受损生态环境,这是全国法院首个主动将生态环境修复资金跨省移交给受损地法院的案例,在2022年全国两会上被写入最高人民法院工作报告;

这些长三角生态环境协同协作的实践,书写了长三角保护绿色答卷。这背后推手是长三角地区三省一市人大的积极作为,展现了人大在长三角绿色发展一体化中的担当作为。
近年来,长三角地区三省一市人大围绕生态环境公益诉讼,同步开展立法、调研、视察或者专项监督,支持行政机关、监察机关、审判机关、检察机关共同推进公益诉讼区域协作,以相关工作的“同质化”推动生态环境公益诉讼工作的“一体化”,努力打造生态环境共保联治的生动局面。
“推动深化生态环境公益诉讼协作,是携手共建绿色美丽长三角的当行之举,也是三省一市人大监察和司法委员会肩负的政治责任。”安徽省人大监察和司法委员会副主任委员姜明说,长三角区域肩负着率先实现建设美丽中国先行区、高质量发展共同富裕和中国式现代化的重要使命,落实长三角一体化发展规划纲要充分领会有关专项规划、三省一市三年行动计划等政策文件精神,充分发挥人大立法、监督、决定等职能作用,不断把长三角生态环境保护提高到新水平,在推动长三角一体化高质量发展中彰显人民代表大会制度的独特优势和治理效能。
